What the Law Says

In Poland, the procedure for medical examinations and psychological tests is strictly regulated:

Law on Road Transport (2001)
Art. 39j sec. 1, 6 (medical examinations) and Art. 39k sec. 1–2, 4 → the driver is obliged to undergo medical examinations with doctors authorized to work with driver candidates.
Law on Drivers of Vehicles (2011)
Art. 79 sec. 1 (medical examination) and Art. 83 sec. 1 (psychological examination) → psychological tests are conducted only in certified psychological laboratories registered with the Marshal of the Voivodeship.
Regulation of the Minister of Health (2008, 2014)
§ 2, §3, §4, §10 → examinations are conducted in person, after identity verification and signing a health declaration.

Conclusion: certificates can only be obtained in person and only in Poland, from doctors and psychologists listed in official registers (WOMP).

How Scammers Operate

The most common schemes:

“Online medical examination via monitor” (especially popular in Belarus). The driver supposedly undergoes a consultation with a doctor and psychologist via webcam, and then receives ready-made certificates. These documents are not recognized in Poland and the EU. For ITD, this is direct grounds to annul Code 95 and disqualify the driver.
Selling ready-made certificates for money without a doctor’s visit.
“Accelerated packages” where the doctor does not even see the driver.
Documents from organizations not listed in the WOMP register or psychological laboratories.

Important: Certificates issued outside Poland (e.g., in Belarus or Ukraine) are not recognized.

What Are the Risks of Buying Fake Certificates

Fines: The carrier receives several thousand zlotys, and the driver is removed from the route.
Annulment of Code 95: If a certificate is found to be fake, it will be deemed invalid.
Criminal liability: Falsification of medical documents is punishable by Polish law.
Loss of employment: Companies immediately dismiss drivers with fake certificates.
Deportation: A deliberate violation can lead to deportation from Poland and the EU for 2–3 years. This effectively bans returning to work in Europe.

Never agree to an “online medical examination.”
Verify the doctor — they must be in the WOMP register.
Be cautious if everything is offered to be processed “remotely.”
Retain original documents with stamps and receipts.

The Road Transport Inspection (ITD) regularly identifies fake certificates. In such cases:

the driver is removed from the route;
the company receives a fine;
documents are forwarded to the prosecutor’s office.

Therefore, employers in Poland particularly strictly require Polish medical certificates and psychological tests.
